2. Nature of the intermediary’s activities

All client advisors are qualified insurance intermediaries with the appropriate training and continuing education, and are registered in the FINMA (Financial Market Supervisory Authority) intermediary register. Your client advisor is contractually an independent intermediary. This means he is not exclusively bound to any specific insurance company and represents the interests of his clients, thus he can offer insurance products independently. He submits his applications to CLARK Switzerland AG, which acts as an intermediary.

CLARK Switzerland AG is registered as an independent intermediary with FINMA and, by law, operates exclusively on behalf and in the interest of the client, acting within the legal and regulatory framework.

3. Compensation details

CLARK Switzerland AG is compensated by insurers with customary commissions and initial fees. These commissions vary depending on the type of insurance brokered and include:

  • Basic insurance (KVG): CHF 70 per successfully brokered basic insurance.
  • Supplementary insurance (VVG): Between 12 and 24 monthly premiums of the VVG premium, depending on the specific insurance and agreed terms.
  • Provision contracts (Pillar 3a and 3b): The commissions vary between 10 ‰ and 53 ‰ of the plan sum.
  • Vesting solutions: Similar to provision contracts, these commissions vary and are calculated individually, ranging from 1% to 3% of the vested amount.

These compensations allow CLARK Switzerland AG to waive an additional advisory fee. The client is informed that these commissions are economically regulated and the advisors are trained accordingly to explain all product-specific features transparently.

In the event of contract amendments, cancellations, credits, charges within 3-5 years of client contracts, a cancellation (repayment of commissions and fees) occurs in the amount of 0 to 100%. These amounts are borne 100% by CLARK Switzerland AG and the client advisors proportionally.

CLARK Switzerland AG finances its own employees, its entire internal and external structure such as back office, marketing, IT and developments, digitizations, accounting and invoicing, all expenses and fees, rents, utilities, and other operating costs.

4. Collaboration with insurance companies

As an independent insurance broker, CLARK Switzerland AG works with a wide range of insurance companies and also broker pools, with ongoing collaboration contracts or valid cooperation agreements in place.

CLARK Switzerland AG collaborates with the aforementioned companies depending on the insurance needs of its clients in all branches of insurance. All companies are selected based on careful criteria. However, this selection does not cover the entire market.

Disclosure of compensations according to Art. 45b of the Insurance Supervision Act

The client has the right to be informed about the actual compensations received. This includes all commissions and fees that CLARK Switzerland AG receives for brokering insurances. The amount of compensations varies depending on the product and insurance company and is disclosed transparently to the client upon request.

Duty of care

CLARK Switzerland AG commits to working with the utmost diligence and care, following all regulations and guidelines of internal quality management. In case of errors or incorrect information due to negligence, CLARK Switzerland AG is liable within its professional liability insurance with AXA Winterthur (Policy No. 14.688.017). This insurance covers financial losses up to CHF 5’000’000 and personal and property damages up to CHF 10’000’000.

Data protection and confidentiality

CLARK Switzerland AG treats all known data according to the Data Protection Act (DSG) confidentially and does not share it with third parties without consent.
